Terms and Conditions of Use

​

  • Payment

    • All invoice payment terms offered are: Prepaid, 50% Down Payment, Upon Completion, COD, Net 30 days, or a combination thereof.

    • AAAMS reserves the right to change payment terms at management's discretion. 

    • Overdue accounts are subject to COD terms and/or suspension. 

    • Any customer that fails to make payment within a 5-day grace period will have their account suspended including parts, repairs, and service.

    • All Credit Card Payments will be assessed a convenience Fee. 

  • Claims:  If any customer has an issue with products or Services rendered please give us the opportunity to hear your concerns and make it right. In order to serve you to the best of our ability, claims should be made in a timely manner.  

    • Invoicing: Claims arising from invoices must be made within seven business days from the date of receipt.

    • Parts/Parts Repairs: Claims arising from parts and parts repairs must be made within seven business days from the date of confirmation of delivery of said parts. 

    • Service: Claims arising from service work must be made within seven business days from the date of completion of the work.

    • All claims must be in writing and emailed to Joseph Robinson, Matthew Robinson, and Dr. Amanda Ball Joseph@aaams.co, Matthew@aaams.co, Amanda@aaams.co

  • Parts Return:

    • Unopened parts may be returned: Customer responsible for all S&H fees. 

    • Restocking fee of 25% (1-30 days), 30% (31-60days), 50% (60-90 days) will be charged. 

    • Returns unavailable after 90 days from the date of estimated delivery.

  • Shipping: Standard shipping is ground with $100 of insurance.

    •  Expedited shipping and additional shipping insurances available upon request and at cost. 

    •  Once a product leaves AAAMS’s hand and is in the possession of the shipper the following apply:

      •  AAA Maintenance Solutions is no longer liable for the safety or transportation of your products. 

      •  AAA Maintenance Solutions is not liable for downtime or loss in production due to delays in shipping or contents of shipment damaged in transit. 

      • If the customer did not request additional insurance, and the contents of shipment is damaged or lost in shipping, customer is liable for any cost above and beyond the standard insurance including the replacement of the contents of shipment. 

      • Customer is responsible to notify AAAMS in writing if a shipment fails to arrive.

  • Parts Repair: 

    • We will have you ship the device/board/motor to our office. Once we receive it we will give you a quote for repair within 3 business days. If the device cannot be repaired, or you choose not to repair the device, your investment is limited to $250 for the device exam plus return S&H. 

    • The device exam fee is waived upon acceptance of the repair estimate. 

    • If a repair is approved and unsuccessful customer will be given a 50% discount on the repair. Labor and travel will be billed at 75%. 

  • Customer Property Abandonment: If customers leave their property with AAA Maintenance Solutions LLC. for repair, storage, or transport for a term of 180 days or longer without contact, payment, or prearranged agreements then Customer forfeits the right of ownership. AAAMS reserves the right to resell or dispose of said property. 

  • Machine Modifications: Any modifications from the machine’s original design/setup that account for extra-added labor/travel/delays/materials will be billed for at cost.

  • Traveling: Travel is billed at time and expenses including but not limited to:  Mileage, tolls, parking, airfare, baggage, and per diem. All estimates are for a single trip to and from the job site unless specified. Any subsequent returns will be billed at time and materials including travel expenses. Any delays that are a result of customer/dealer/contractor/HVAC/electrician/shipping/trucking company/etc. not meeting the agreed deadline either verbally or in writing may result in additional charges.

  •  

  • Per diem:  Per diem is invoiced for each technician per day. Charges are based on total combined hours of labor and travel served within a 24-hour period.  Under 5 hours one-half per diem. 5-10 hours full per diem. 

  • Repairs: Repairs may become necessary to meet the terms of the sales agreement. Repairs also may become necessary to complete the safety test or meet local, State/Province, or Federal safety standards. Any repairs that are needed to be made will be billed at time and materials.

  • Delays: For every 10 hours totaled (continuous or non-continuous) of delays, modifications, and/or repairs, will be equivalent to one day of labor and will therefore be subject to additional per diem/hotel/parking and other daily travel expenses. If delays persist long enough that cause interference with other preplanned jobs/installations/service calls/repair the technician reserves the right to leave the job site, and return at their convenience (within reason) to finish the job. Additional travel expenses may apply in this situation.

  • Work Performed: All travel and work are quoted to be performed Monday – Friday standard working hours. Any travel or work performed outside of standard hours, as a direct request by the customer will be subject to overtime charges. See www.aaams.co for a list of our standard hours & current overtime rate multipliers. 

  • Estimates: To secure estimated services a PO#, signed estimate, signed contract (if applicable) is required. In addition, any job exceeding $7,500.00 USD will require a 50% Down Payment to retain our services. The balance is due upon completion. Prices are subject to change and are only guaranteed for 15 days from the date of estimate. All materials used in the installation are the property of AAA Maintenance Solutions LLC until paid for in full.

  • Cancellation:  Should the customer cancel within 30 days of the agreed start date, a 50% down payment, cost of travel arrangements that cannot be canceled or materials purchased that are not returnable, shall be non-refundable to the customer. 

  • Estimates: Quoted price on estimate may vary +/- 15% without prior approval. The quoted price is based on the price of materials and travel expenses at the time of delivery of the estimate or invoice. Estimates are valid for 15 Days.

  • Warranty: Unless a warranty is specifically listed out in an estimate, invoice, or contract, there will be no warranty inherent, expressed, or otherwise. Parts will be sold as is in the listed description.

  • Dispute Settlement: Any dispute that cannot be resolved between AAA Maintenance Solutions LLC and the customer named, will be handled solely through arbitration in Alamance County, North Carolina. 

  • Customer Insurance: The customer is fully responsible for their building, personnel, and equipment. Customer is to maintain commercial general liability insurance, workers compensation insurance, and equipment insurance. 

  • AAAMS Insurance: AAA Maintenance Solutions LLC will maintain commercial general liability insurance, workers compensation insurance and automobile insurance.

  • Customer Liabilities & Responsibilities: While facilitating Service at a customer’s location the customer will have the following liabilities and responsibilities for AAAMS employees and subcontractors.   

    • Provide clean and sanitary bathrooms

    • Provide adequate means of hand washing 

    • Provide access to the facility 

    • Provide a machine operator to assist in the troubleshooting and repair if needed. 

    • Provide a safe working environment that supports the physical/mental safety of our technicians and subcontractors. 

    • Provide a safe and secure place for all property including but not limited to tools, computers, equipment, materials, supplies, trailers, and trucks. 

    • Provide compensation for any property that is lost or stolen while on your location whether it be by a customer’s employee, agent, vendor, supplier, other contractor, trespassers, or other individual. 

    • Provide punctual payment per agreed terms. Including down payments and final payments.

    • All of the above liabilities and responsibilities are applicable to third parties (such as OEM’s or machine dealers) who hire AAAMS and AAAMS subcontractors to perform service at a customer’s location. 

  • Photo Release: I hereby grant AAAMS permission to use photographs, video,  and Audio capturing devices to document repair work at my location. 

    • . I understand and agree that all photos will become the property of the AAAMS and will not be returned. 

    • I hereby irrevocably authorize the AAAMS to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. 

    • Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo. I hereby hold harmless, release, and forever discharge the AAAMS from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization. 

  • Updates: AAAMS reserves the right to update the Terms and conditions at any time. Updates are posted at the AAAMS Website  (www.aaams.co). 

  • By assigning AAAMS a PO# and/or making a payment in any amount towards an estimate/invoice you agree to the above-stated terms and agreements.

Refunds & Payment Collection

We take your investment seriously, and we’d appreciate it if you took our investment of time and resources into your success seriously too.  Due to the nature of the services and/or products provided, refunds will not be given unless otherwise specified in writing. AAA Maintenance Solutions, LLC. reserves the right to charge 1.5%  interest per day upon any outstanding sum left unpaid on or after 14 calendar days from the due date. After 30 days of outstanding payment AAA Maintenance Soltuions, LLC,  reserves the right to send you to collections, upon which you will owe the total amount of any outstanding payments plus any collection costs including reasonable attorney’s fees.
